MINIMUM ACCESS SERVICE COMPLEX
JSC "LatRailNet" charges for the minimum set of access services and for access to the infrastructure, connecting the infrastructure with the service points, which shall be determined in accordance with the direct costs of the provision of train traffic services. In order to avoid discrimination, the average charge and the marginal charge for equivalent uses of the infrastructure shall be comparable. The same fees apply to the same services in the same market segment.
JSC "LatRailNet" makes a decision on the calculated charge and submits all the necessary information about it to the State Railway Administration.
JSC "LatRailNet" ensures that the said fee, which is actually calculated for the carrier in compliance with the relevant regulations, is calculated in accordance with the information specified in the network statement. JSC "LatRailNet" publishes decisions on the amount of the fee on its website, indicating the date of publication of these decisions.
The fee for the minimum set of access services and for access to the infrastructure connecting the infrastructure with the service points shall be collected by the public railway infrastructure manager in accordance with the charging scheme developed and approved by JSC "LatRailNet" (after consultation with applicants and public railway infrastructure manager). The public railway infrastructure manager shall use the received fee to finance its economic activity.
The minimum set of access services includes the following services: handling of requests for infrastructure capacity (decision-making on infrastructure capacity allocation, allocation of train paths, including both the identification and assessment of access and the allocation of individual train paths, and decision-making on infrastructure charges, including the calculation and collection of charges), the right to use the allocated infrastructure capacity (statutory administration of the sector and the operation of the infrastructure manager), use of infrastructure, incl. tracks (including switches and crossings), platforms, civil infrastructure and related fixed installations and safety facilities necessary for the reception, passage and release of trains, passenger platforms and associated external lighting equipment, train movement control, including signaling, control, signaling services and communication, as well as the provision of information on train movements, use of traction power supply equipment, provision of information.
In order to change or adjust the amount of network access charges according to specific circumstances, JSC "LatRailNet" may apply specific infrastructure charge differentiation tools to any of the components of infrastructure charge parameters.
CONGESTION CHARGES
Congestion charge is an additional charge which reflects the scarcity of infrastructure capacity on a given part of the infrastructure during periods of congestion. The amount of the congestion charge shall be determined according to the change in the infrastructure cost resulting from the maintenance costs related to the infrastructure capacity enhancement plan and the cost of raising the borrowed capital of the infrastructure manager's intended long-term investment.
ENVIRONMENTAL CHARGE
The charge may be varied to take into account the cost of the environmental impact of the train service. The decision shall be made in accordance with the End-User-Oriented Operational Objectives in the field of environmental protection, provided in the multi-annual agreement, the decision of the Cabinet of Ministers referred to in Section 11, Paragraph eleven of the Railway Law on granting compensation, the amount and payment procedure.
PROJECTS CHARGE
Increased charge for specific investment projects, which are not provided in the multi-annual contract, but which increase the operational efficiency or cost-effectiveness of the applicants and where this could not or could not have been achieved otherwise. The amount of the charge shall be determined taking into account the changes in costs related to a specific investment project (including the part of the value of long-term investments to be written off during the planning period, which does not exceed the efficiency-related savings of the applicants).
DISCOUNTS

a volume discount for a specific market segment, if in the planning period the volume of transportation of the specific market segment exceeds the forecasted amount of train kilometers (determined by determining the mark-up of the infrastructure charge of the relevant market segment);

network congestion optimization discount for a specific part of the infrastructure where it is established that the demand for infrastructure capacity is not reaching optimum capacity and where, on the basis of efficient, transparent and non-discriminatory principles, it can be established that the rebate may stimulate capacity utilization.
NETWORK IMPROVEMENT CHARGE
JSC "LatRailNet" may impose sanctions for actions that disrupt the operation of the infrastructure, compensation to the infrastructure manager or railway undertakings that suffer losses due to disruption, and bonuses if the delay exceeds the allowable delay limits specified in the Network Performance Scheme and if the delays have caused delays on the trains of other railway undertakings.
CHARGES FOR CAPACITY MAINTENANCE AND TECHNOLOGICAL PROCESSES
Infrastructure charges are not applicable to trains and rolling stock designated by the infrastructure manager that do not participate in rail freight or passenger transport by rail, but are related to the prevention or elimination of the consequences of an accident, maintenance of infrastructure, performance of all repairs.
Charges for capacity used by rolling stock and trains of carriers and certain technological operators who do not participate in freight or passenger transport by rail but provide technological processes (construction, repair and maintenance of technical infrastructure, modernization of railway rolling stock, repair, train and preparation of locomotives for transport, movement of locomotives, etc.), shall be determined in the amount of direct unit maintenance and train movement control costs.
PAYMENT OF THE APPLICATION ENSURING
JSC "LatRailNet" also determines the charge for the services provided (performance of the essential functions referred to in Article 1, paragraph 23 of the Railway Law). Such application ensuring payment for the capacity allocated in the infrastructure capacity allocation plan (regardless of whether the capacity is actually used) shall be determined and applied in accordance with the full costs of the JSC "LatRailNet" unit.
MARK-UP CHARGES
Mark-ups of the charges shall be applied on the basis of efficient, transparent and non-discriminatory principles, while guaranteeing optimal competitiveness. The charging system takes into account the productivity gains achieved by undertakers. The level of charges shall not prevent the use of infrastructure by market segments which can at least cover the direct costs of train traffic as well as the profit margins allowed by the market situation. JSC "LatRailNet" evaluates the significance of mark-ups in specific market segments, as well as evaluates the need for a more detailed division of certain market segments by transported cargo or passengers. The existing segmentation is based on the impact of different infrastructure uses on infrastructure costs, on the productivity gains achieved by railway undertakings or on the impact of the level of mark-ups on the competitiveness of final services.
